"An Unprecedent Inquiry": Manhattan DA Fires Off Angry Letter Blaming Trump For Arrest Rumors
BY TYLER DURDEN THURSDAY, MAR 23, 2023 - 12:42 PM Manhattan District Attorney Alvin Bragg - who lied about growing up poor, has fired off an angry letter to House Republicans, calling their investigation into his case against former President Trump over hush payments to Stormy Daniels "an unprecedent [sic] inquiry into a pending local prosecution," adding "The letter only came after Donald Trump created a false expectation that he would be arrested the next day and his lawyers reportedly urged you to intervene." "You are reportedly about to engage in an unprecedented abuse of prosecutorial authority: the indictment of a former President of the United States and current declared candidate for that office," read the Monday letter to Bragg from Reps. Jim Jordan (Judiciary Chairman), James Comer (Oversight Chairman) and Bryan Steil (House Admin Chairman). The letter went on to shred the 'untested legal theory' underpinning Bragg's expected indictment, and calls out former Trump Attorney Michael Cohen, Bragg's star witness and a convicted perjurer, as having a "serious credibility problem." GOP investigators demanded all documents and communications related to the decision. And now, Bragg claims the GOP is overstepping their bounds. Indictment Backfire: Poll Shows Majority of Americans Think Charges Will Either Help Trump or Have No Effect
MATTHEW BOYLE 24 Mar 2023 Washington, DC New polling suggests that a majority of Americans believe a looming indictment of former President Donald Trump from Manhattan District Attorney Alvin Bragg will backfire and either not hurt him or actually help him in his quest to retake the White House. The results of the poll, conducted by Convention of States Action in conjunction with the Trafalgar Group, were obtained by Breitbart News exclusively ahead of their public release. These results appear to be the first polling numbers conducted fully after Trump announced last weekend that he expected to be charged imminently, and show the solid majorities of Americans believe the indictment will not hurt Trump at all. A whopping 74 percent of Americans believe that an indictment of Trump either helps him or will have no effect on his presidential campaign — 37.5 percent said it will not affect him and 36.8 percent said it will help him. Only 25.7 percent of voters surveyed think it will hurt his presidential campaign. “It’s obvious to the majority of Americans that former President Trump is being hounded by a politically motivated witch hunt designed to discredit him in order to render him a permanent pariah in American politics,” Mark Meckler, the president of Convention of States, said. “This tactic has never worked, and these early numbers already reveal it’s going to backfire. Voters either think his indictment and arrest will either have absolutely no impact on his 2024 bid, or that it will even boost his campaign.” Broken down by political party of respondents shows a pretty consistent view across the board among Democrats, independents, and Republicans — though among Republicans those who think it will help Trump jumps up into a clear majority. Among Democrats, more than 57 percent believe an indictment would either not affect or help Trump’s campaign — 42.5 percent think it will have no effect and 14.8 percent think it will help him — while just 42.7 percent say it will hurt him. Among independents, more than 72 percent think an indictment will have no effect or help Trump — 38.9 percent think it will have no effect and 33.6 percent say it will help him — while just 27.5 percent say it will hurt Trump. Among Republicans, perhaps the most interesting group in the immediate term because these voters will decide the primary, a solid majority of 56.2 percent believe that an indictment would actually help Trump in his bid to retake the White House. Another 32.5 percent of Republicans say an indictment would have no effect on Trump’s White House chances — meaning that in total nearly 89 percent of GOP voters believe that an indictment would either help Trump or have no effect on his campaign — whereas just 11.3 percent say an indictment would hurt Trump. The poll was conducted from March 20 to March 22, and surveyed 1,081 likely general election voters. It has a margin of error of 2.9 percent. link

Friday’s status on the grand jury is that after not meeting on Wednesday the grand jury did not meet again in the Trump case on Thursday and it now appears an indictment is not coming this week a WSJ article reported that grand juries don’t meet on Fridays. So now there is a weekend for everyone to catch up with the news. A report from The Wall Street Journal details “chaos and last-minute shuffling within the Manhattan District Attorney’s Office,” adding that District Attorney Alvin Bragg is “scrambling” to indict Trump. The grand jurors who will eventually hear the Trump case did convene on Thursday but discussed “another matter unrelated” to Trump. “It is common for grand juries in New York to hear multiple cases at a time,” the Journal’s Corinne Ramey wrote. “Grand jury schedules can be unpredictable because panels juggle cases with competing demands and deadlines, former prosecutors said.” Sabia reported details about the case that will be brought under new scrutiny- saying the case involves Trump’s alleged role in hush money payments to adult film star Stormy Daniels ahead of the 2016 election, allegedly to keep Daniels quiet about an affair the two of them had in 2006. Bragg responded on Thursday to a potential indictment and arrest of Trump and issued a vague statement that did not actually provide any information about what might happen next. The Conservative Brief report went on: “Bragg sent a letter to members of the House Judiciary Committee after they sent their own letter “demanding communications, documents, and testimony relating to Bragg’s unprecedented abuse of prosecutorial authority and the potential indictment of former President Donald Trump.” In his letter, the Manhattan DA said his office will “publicly state the conclusion of our investigation—whether we conduct our work without bringing charges, or move forward with an indictment.” Bragg also addressed the letter the House Judiciary Committee previously sent to his office and said, “Your letter dated March 20, 2023, (the ‘Letter’), in contrast, is an unprecedented inquiry into a pending local prosecution. Alvin Bragg Blinks: Manhattan Trump Grand Jury Set To Break For A Month
David Hawkins March 29, 2023 - 1:21 pm Former President Donald Trump got another big break and Manhattan District Attorney Alvin Bragg got some bad news regarding the Manhattan grand jury that will vote on Trump’s indictment. After facing massive backlash from even allies on the left, Bragg seems to have gotten cold feet with his impending indictment. At one point barricades were set up in New York in anticipation of a Trump arrest but then nothing. Even CNN questioned Bragg’s antics with Van Jones telling him he was making a mistake. And now Bragg will have to wait at least another month before making his move because the grand jury is set to take a long break. The grand jury isn’t meeting Wednesday and is expected to examine evidence in a different case Thursday sources told Politico. The grand jury typically meets Mondays, Wednesdays and Thursdays. According to Politico: The Manhattan grand jury examining Donald Trump’s alleged role in a hush money payment to a porn star isn’t expected to hear evidence in the case for the next month largely due to a previously scheduled hiatus, according to a person familiar with the proceedings. The break would push any indictment of the former president to late April at the earliest, although it is possible that the grand jury’s schedule could change. In recent weeks, the Manhattan district attorney’s office hasn’t convened the panel on certain days. But it is District Attorney Alvin Bragg’s prerogative to ask the grand jury to reconvene if prosecutors want the panel to meet during previously planned breaks. link

Trump on Thursday for his role in paying hush money to a porn star, according to four people with knowledge of the matter, a historic development that will shake up the 2024 presidential race and forever mark him as the nation’s first former president to face criminal charges,” the New York Times reported on Thursday evening. “The felony indictment, filed under seal by the Manhattan district attorney’s office, will likely be announced in the coming days. By then, prosecutors working for the district attorney, Alvin L. Bragg, will have asked Mr. Trump to surrender and to face arraignment on charges that remain unknown for now.” What kind of BS is this? As for now, it remains unclear how and if Trump will appear in New York to face the reported charges but several reports in recent weeks have indicated that U.S. Secret Service agents assigned to Trump’s detail have been working with local officials in Manhattan District Attorney Alvin Bragg’s office to coordinate such a possibility. “Mr. Bragg and his lawyers will likely attempt to negotiate Mr. Trump’s surrender,” the Times added in its report. “If he agrees, it will raise the prospect of a former president, with the Secret Service in tow, being photographed and fingerprinted in the bowels of a New York State courthouse.The prosecution’s star witness is Michael D. Cohen, Mr. Trump’s former fixer who paid the $130,000 to keep Ms. Daniels quiet. Mr. Cohen has said that Mr. Trump directed him to buy Ms. Daniels’s silence, and that Mr. Trump and his family business, the Trump Organization, helped cover the whole thing up. The company’s internal records falsely identified the reimbursements as legal expenses, which helped conceal the purpose of the payments.” Assuming this report is true, Trump would be the first former president in American history to face criminal charges. Since Trump is running again for president as well, this news would also throw a serious curveball into the political calculus for the 2024 presidential campaign–both in a primary and a general election. Several of Trump’s declared and possible rivals in the 2024 GOP primary denounced Bragg after Trump announced last weekend he expected to be indicted soon, and how each handled their response to it was critical for the possible or actual candidacies of each. What’s more, congressional Republicans raced to respond to the news last week as well–with House Speaker Kevin McCarthy directing not one but three separate congressional panels to investigate Bragg in response. Bragg brushed off initial inquiries into the matter from House Oversight Committee chairman Rep. James Comer (R-KY), House Judiciary Committee chairman Rep. Jim Jordan (R-OH), and House Administration Committee chairman Rep. Bryan Steil (R-WI). Their response from here is almost certainly going to escalate. Trump for the last couple weeks has criticized Bragg and his office, insisting that he is innocent and questioning why he would face charges. Interestingly, as The Epoch Times' Jack Phillips reported, this month-long delay came after an attorney in former President Donald Trump’s orbit who testified in front of a Manhattan grand jury earlier this month believes that there has been a shift in Manhattan District Attorney Alvin Bragg’s case against the 45th president.
“Well, I think I got through to them, because [Monday] I understand they called back another witness by the name of David Pecker, who used to run the National Enquirer,” Costello, a former Michael Cohen attorney, told Newsmax on Tuesday.
“Basically, what they’re doing is really gerrymandering this,” he said of Bragg’s probe into Trump.
Costello said he had represented Cohen, himself a former Trump lawyer, and told reporters last week that he does not believe Cohen is a credible witness against Trump.
Sounds like that wasn't the case.
The prosecution's star witness in the case is former Trump attorney Michael Cohen, who paid Stormy Daniels $130,000 to keep quiet about sleeping with Trump. Cohen said that Trump directed him to buy her silence (contrary to a 2018 letter from his lawyer claiming the opposite), and says that the Trump organization helped cover it up.
The case brought by Mr. Bragg, a Democrat, is far from a sure bet. Mr. Bragg’s predecessor, Cyrus Vance Jr., and federal prosecutors each passed on charging Mr. Trump in a stand-alone case related to the hush money. If the case goes to trial, a conviction would almost certainly require a jury to credit the testimony of former Trump attorney Michael Cohen, who has faced his own legal troubles and pleaded guilty to an array of federal felonies in 2018. Among them was a campaign-finance offense for the porn-star payment, as well as charges of lying to a bank and to Congress. -WSJ

The indictment is an absolute scandal, the banana republic on parade, the prosecutor using the weapons of his office to attack his political opponent.
Bragg and his predecessor’s slow-walking of the investigation, with its inception by Manhattan DA goes back to 2019, evidences both the dubious nature of the case against Trump and the political motivations for prosecuting Trump. Theoretically, this should be a simple case. Yet the investigation went on for nearly five years, despite what they’ve possessed: overzealous prosecutors who wanted to charge Trump with racketeering, the cooperating witnesses, the likely millions of pages of materials from the Trump Organization.
Now suddenly, the insanely pro-criminal Manhattan DA, who demanded his prosecutors reduce charges for violent criminals, is prioritizing law and order. It’s hard to believe there are legitimate reasons – for prosecutors, that means seeking justice – for that transformation. Why bring the case now? It’s the start of the 2024 presidential campaign season.
You can’t help but think of the political calculations that went on in Bragg’s head. Not only does he benefit personally, now elevated to a liberal folk hero after being the prosecutor to finally get Trump (a campaign promise he keeps), but this throws a grenade into the Republican race. Will the GOP base rally to Trump? How will the other candidates respond?
And what will this do for the undecideds and the independents and the swing voters – those who are essential to victory in 2024?
Some of those questions will be answered in the short term. Some of them won’t be answered until election day, assuming Trump gets the GOP nod.
That’s because the case won’t go away. It’s illegitimate and political, but it’s here to stay for the time being. Don’t be surprised if the trial date is set for the first half of 2024. And don’t understate the danger to Trump, who will face a jury of Biden voters. Biden won Manhattan 86.7% to 12.3% according to the New York Times. The jury of Trump’s peers will be friendly to the prosecution. That’s all the Manhattan DA might need to secure a conviction. Trump could very well win on appeal but the damage - which carries national repercussions - might already have been done.
And that’s the whole point of this dirty scheme.

Nancy Pelosi (D-CA), the former Speaker of the House who impeached President Trump twice out of spite, issued a statement Thursday night on Trump’s indictment by a Manhattan jury that turned the justice system on its head. Pelosi said that Trump “has the right to a trial to prove innocence.” The American standard of justice is that the government has to prove a defendant guilty beyond a reasonable doubt. Defendants do not have to prove anything and have a Fifth Amendment right to not be “compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law.” Pelosi’s statement was posted online, “The Grand Jury has acted upon the facts and the law. No one is above the law, and everyone has the right to a trial to prove innocence. Hopefully, the former President will peacefully respect the system, which grants him that right.” Cornell Law definition of the “beyond a reasonable doubt” burden of proof for prosecutors: “Beyond a reasonable doubt is the legal burden of proof required to affirm a conviction in a criminal case. In a criminal case, the prosecution bears the burden of proving that the defendant is guilty beyond all reasonable doubt. This means that the prosecution must convince the jury that there is no other reasonable explanation that can come from the evidence presented at trial. KRISTINA WONG 31 Mar 2023 The Washington Post’s editorial board on Friday called the District Attorney of New York Alvin Bragg’s case against former President Donald Trump “shaky” and a “poor test case” for indicting a former president. “Public perception and political strategy shouldn’t dissuade a district attorney from bringing a solid case, but neither should they persuade him to bring a shaky one,” the editorial board wrote on Friday. On Thursday evening, news broke that the grand jury in Bragg’s case had voted to indict Trump. While the indictment has not yet been unsealed, it is widely expected that Bragg will bring state criminal charges against Trump for allegedly falsifying business records in 2016 to hide an alleged federal campaign finance violation. Specifically, Bragg is expected to argue that Trump falsified business records by mislabeling a reimbursement to his then-lawyer Michael Cohen, who paid hush-money to porn actress Stormy Daniels, as legal expenses. Bragg is then expected to argue that Trump’s campaign did not report the payment to Daniels as a campaign expense, in violation of federal campaign rules. But the strategy is also novel, and courts may regard it with skepticism. What’s more, the potential campaign finance charge itself is shaky,” it wrote. The editorial board noted that when federal prosecutors tried to charge former Sen. John Edwards (D-NC) with a campaign finance violation for paying hush-money to a woman he had an affair with, Edwards successfully argued he was trying to prevent his wife from finding out rather than trying to benefit his campaign. The trial ended in an acquittal, and the Justice Department dropped the case. The Post’s editorial board argued that although campaign finance violations should be taken seriously, there were potential downsides of indicting Trump. They argued that there were better cases to bring against Trump, and this case could put those in jeopardy: This prosecution is now bound to be the test case for any future former president, as well as, of course, proceedings against this former president in particular — of which there are plenty. Andy Biggs of Arizona spoke out against the weaponized Manhattan DA’s office on Thursday, following news of President Trump’s indictment by “a Leftist District Attorney funded and selected by George Soros.” The Congressman vowed to “ensure that every single federal dollar is rescinded from this office and to restore impartiality in our courts.” The Gateway Pundit reported that DA Alvin Bragg sent out a new letter to House Republicans this morning, boasting about his indictment of Trump and accusing them of “collaborat(ing) with Mr. Trump’s efforts to vilify and denigrate the integrity of elected state prosecutors and trial judges and made unfounded allegations that the Office’s investigation, conducted via an independent grand jury of average citizens serving New York State, is politically motivated.” This is despicable. He has no shame for his unconstitutional actions and it is clear that the Democrats have been emboldened to destroy America. The payments made to Stormy Daniels did NOT come from Trump’s 2016 presidential campaign. The payments were made through internal business records – there was no tax deduction taken and there was no obligation to file it with the FEC, according to Joe Tacopina. A Manhattan Grand Jury voted to indict President Trump anyway. The indictment is currently under seal, however, according to a leak to CNN, President Trump was hit with 34 counts related to business fraud. Details of the charges are still not known. President Trump is expected to be arraigned on Tuesday at 2:15 PM ET in New York City on the garbage charges. On Friday Harmeet Dhillon joined Tucker Carlson to discuss the criminal leak on the New York City DA’s garbage indictment of President Donald Trump. Harmeet suggested the Soros-funded DA will attempt to silence President Trump with a gag order. That way the communist left can prevent President Trump from campaigning. Tucker Carlson: You have seen cases, politicized cases, as with Roger Stone, in which the person charged is gagged by the judge and not allowed to speak about the charges. This is increasingly common, in violation of the First Amendment, obviously. But it happens. If this happens to Donald Trump, he will lose his free speech rights as a candidate in a presidential race. And I’m just wondering if you think that could potentially happen. The story is that because he says mean things about people sometimes on his free speech platforms, that he should not be allowed to speak about a fundamental issue of due process that governs the future of our country and how we look at justice and how we look at the politicization of this political process. So that would be a gross miscarriage of justice if it occurs. And I would not be surprised to see this politicized prosecutor make that request of this judge. Tucker Carlson: I honestly think it’s impossible to imagine greater election interference, a greater or more aggressive attack on our democracy, than gagging a presidential candidate in a presidential year. I mean, Vladimir Putin has never dreamed of any attack on the United States more damaging than that. Would anyone be able to stop it? Harmeet Dhillon: Well, certainly the lawyers in this case will argue against that… But at the end of the day if a court sets those rules, then the litigant has to abide by them or be in contempt of court. The New York Post reported on the indictment: Bragg is inflating a minor possible crime into a felony so he can launch his own campaign for re-election. How bad is the case? Let us count the ways. The key witness, lawyer Michael Cohen, is a congenital liar. Precedent shows that in other similar cases, such as against one-time presidential candidate John Edwards, the defendants have been found not guilty. Bragg’s own predecessor — and the feds! — declined to bring this case against Trump for six years. Bragg is trying to convert a state-level misdemeanor, falsifying financial records, into a federal felony. A less self-interested prosecutor would have dropped it and . . . we don’t know, gone after the scourge of gun violence or the shoplifting and robbing epidemic on New York’s streets? Trump faces investigations that are, to our minds, far more serious: his actions on Jan. 6 and pushing for Georgia to “find votes” for him. The Stormy Daniels case is a goose egg that just convinces America that our legal system is biased and politicized.
