Multiple States Back Texas in Battle with Biden over Border Defense
Frank Bergman January 25, 2024 - 11:55 am2 Comments Several states have announced their support for Texas as Republican Gov. Greg Abbott continues to battle with Democrat President Joe Biden’s administration over the state’s right to defend its border. Texas made clear Wednesday that it will continue to defend itself and America’s frontier against the ongoing “invasion” of illegal aliens. Support for Texas is now growing despite efforts by the Biden admin to otherwise render the Southern Border wide open. Other Republican states have begun to rally behind Texas, assuring border communities in the Lone Star State that they are not alone. A number of other states have now called out the White House for its apparent failure to address the crisis at the border. On Wednesday, Gov. Abbott issued a statement stressing that Texas has the “constitutional authority to defend and protect itself.” The governor argues that this authority “supersedes any federal statutes to the contrary.” Abbott’s provocative statement came days after the U.S. Supreme Court vacated a lower court’s order against Biden’s Department of Homeland Security (DHS). The ruling allowed DHS to cut through defensive razor wire along the Southern Border in Texas to allow illegals to flood in from Mexico. “The federal government has broken the compact between the United States and the States,” wrote Abbott. “The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting States, including immigration laws on the books right now. “President Biden has refused to enforce those laws and has even violated them.” Abbott asserts that the Biden admin’s failure to fulfill its duty to protect each state against invasion, codified in Article IV, Section 4 of the Constitution, has “triggered Article I, § 10, Clause 3, which reserves to this State the right of self-defense.” The governor’s statement appeared to account for why Texas began installing more wire and border defenses this week with state agencies vowing to hold the line. Texas has added more defenses in defiance of the Biden White House, which admitted the razor wire at the border “got in the way” of letting future Democrat voters enter the country illegally. In response to Texas’ stated and visible efforts to protect both American sovereignty and itself, various Democrats called on the geriatric president to seize control of the Texas National Guard and to all but force the Lone Star State to submit. Several Republican governors have expressed support for Texas’ self-defense or have at least decried the Biden administration for letting things degenerate to the point where such defense was required. One hour after Abbott shared his statement online, Oklahoma Gov. Kevin Stitt (R) announced, “Oklahoma stands with Texas.” Florida Gov. Ron DeSantis wrote: “If the Constitution really made states powerless to defend themselves against an invasion, it wouldn’t have been ratified in the first place and Texas would never have joined the union when it did. “TX is upholding the law while Biden is flouting it. “FL will keep assisting Texas with personnel and assets.” Virginia’s Republican Gov. Glenn Youngkin later stated: “Virginia stands with Texas. [Abbott] is doing the job Joe Biden and his border czar refuse to do to secure our border. “The Biden administration has turned every state into a border state. “We must stop the flow of fentanyl, save lives, and secure our southern border.” Georgia’s GOP Gov. Brian Kemp said, “Enough is enough. “Our southern border is in crisis thanks to the Biden administration’s refusal to do their job. “[Abbott] and the state of Texas have our full support.” Republican South Dakota Gov. Kristi Noem declared that Abbott “is exactly right to invoke Texas’ constitutional authority to defend itself. “The Biden Administration has created a national security crisis and put Americans in danger. “Their failure is an unconstitutional dereliction of duty. “South Dakota has been proud to help Gov. Abbott’s efforts to secure our border.” Other Republican governors appeared less committed. Nevertheless, many expressed appreciation for Texas and antipathy for the federal government over its apparent inaction. Montana Gov. Greg Gianforte suggested in a tweet that Abbott “is doing what @potus won’t. “By refusing to act, President Biden is inviting cartels, illegal drugs, and human trafficking into the United States. “We must secure the southern border.” Utah Gov. Spencer Cox said: “The border is a disaster that continues to spiral out of control, both in terms of people and deadly fentanyl traffic. “This is not a partisan issue. This is a national security issue. “This is a common-sense issue. This is an American issue. “Utah thanks Texas and Gov. Abbott for stepping up where the Biden Administration has failed over and over again.” Meanwhile, the leaders of other red states — including Govs. Bill Lee (Tennessee), Brad Little (Idaho), Jim Pillen (Nebraska), and Tate Reeves (Mississippi) — have also committed troops, law enforcement agents, support vehicles, and other resources to Texas in recent years with the aim of shoring up America’s defenses. Some Republicans in Washington have also voiced support for Texas and its ability to defend itself. House Speaker Mike Johnson (R-LA) joined Rep. Marjorie Taylor Greene (R-GA) and Rep. As End Wokeness notes, a coalition of 25 Republican governors have signed a joint letter in support of the Texas resistance. The support began on Wednesday, with Governor Kevin Stitt tweeting: "Oklahoma stands with Texas." "TX is upholding the law while Biden is flouting it," said Florida Gov. Ron DeSantis. And of course, the optics couldn't be worse for the Biden administration - which is now faced with the prospect of going to war with Texas, during an election year, to keep the border open. And Wall Street Silver pointed out on X, Texas is authorized to engage in war if being invaded according to Article 1, Section 10, Clause 3 of the Constitution. Though as X user blueapples points out, Abbott cited the dissenting (losing) position in Arizona v. United States which determined that federal law overrides state laws when it comes to regulating those who are unlawfully present in the US, except when it comes to a state's right to require officers to verify the citizenship or alien status of detained migrants. Regardless, Abbott has drawn a line in the sand - and whatever litigation may play out in the courts is secondary to the fact that this is happening now. According to the outlet: McConnell told GOP senators that before border security talks began, immigration policy united Republicans and Ukraine aid divided them. “Politics on this have changed,” McConnell said of solving the crisis at the U.S.-Mexico border. BORDER SHOWDOWN: DHS Sends 2nd Demand Notice to Texas over Seized Park Access
RANDY CLARK 24 Jan 2024 EAGLE PASS, Texas —Department of Homeland Security General Counsel Jonathan Meyer sent a second demand letter to Texas Attorney General Ken Paxton demanding the state of Texas grant full, unimpeded access to a border city park and boat ramp. The Texas Military Department seized Shelby Park in early January. Tuesday’s letter sets a deadline of January 26, for the state to grant the Border Patrol full access to Shelby Park and other areas along a 2.5 mile stretch of the Rio Grande in the small Texas border town of Eagle Pass. The letter, attached below, directly addresses Monday’s U.S. Supreme Court order freeing the Border Patrol to cut wire and fencing installed by the state to gain access to the border under their statutory authority to enter private lands without warrant within 25 miles of the border. The 5-4 decision paused a lower court’s ruling that had previously blocked such action. The letter addresses the issue by saying, “As you are aware, yesterday, the Supreme Court vacated the injunction prohibiting the Department from cutting or moving the concertina wire that Texas had placed along the border except in case of emergency, and restored the Department’s right to cut and move the concertina wire placed by Texas in order to perform their statutory duties. Access through the federal border barrier entrances described above located on Ford Street, Main Street, near the intersection of Rio Grande Street and Ryan Street, and the two entrances on the end of Ryan Street, for Border Patrol to move through and conduct line watch duties and patrol within the Shelby Park area 24 hours a day. Full access to the boat ramp located at Shelby Park Main Street entrance, consistent with the perpetual easement. In Texas, Governor Greg Abbott (R) seems to be openly challenging the administration and the U.S. Supreme Court by instructing the National Guard to construct razor wire barriers along a specific border area near Eagle Pass in order to halt the influx of migrants. Rep. Keith Self (R-Texas) announced an upcoming event called the “Take Our Border Back” multi-day trucker caravan, scheduled to take place from January 29th to February 3rd. By Jack Davis January 27, 2024 at 10:17am Texas is rejecting a Biden administration demand to give federal agents full access to a border park even as the union representing Border Patrol agents says it has no plans to push Texas troops out of the way even if ordered. Throughout January, Texas and the Biden administration have dueled over Shelby Park in the community of Eagle Pass, Texas, which has been flooded with waves of illegal immigrants. Texas National Guard troops have denied federal agents access to the park, leading to a demand from the Department of Homeland Security that Texas do as DHS tells it and grant access to Border Patrol agents. The demand gave Texas until Friday to respond and comply. Instead, Texas Attorney General Ken Paxton wrote in a letter to Jonathan Meyer, general counsel for the Department of Homeland Security, rejecting the demand. “Presumably because you have no meaningful response to our letter, your latest letter abandons earlier factual assertions, asserts new ones, and supplies even less of a legal basis for your demand. Once again, I respectfully suggest that any time you might spend suing Texas should be redirected toward enforcing the immigration laws Congress already has on the books,” Paxton wrote. The letter shot holes in federal claims that it has rights to some areas of the park, mocking a “home-cooked map” purporting to show land the federal government owns, saying, “publicly available records suggest the United States does not even purport to own what your latest letter claims.” The letter also explains an agreement between Eagle Pass and the federal government to access certain land was never approved by the state, as required by law, and therefore is not in effect. “The 2018 easement, however, nowhere contemplates allowing the federal government to deploy infrastructure that President Biden will use to wave thousands of illegal aliens into a park that will ‘continue to [be] use[d] and enjoy[ed]’ for ‘recreation events,’” the letter said. “As I said before, this office will continue to defend Texas’s efforts to protect its southern border against every effort by the Biden Administration to undermine the State’s constitutional right of self-defense. You should advise your clients to join us in those efforts by doing their job and following the law,” he wrote. Texas Gov. Greg Abbott has said Texas has a constitutional duty to respond to an invasion on the part of illegal immigrants, to which Democrats such as Democratic Reps. Joaquin Castro and Greg Casar of Texas have replied by calling for President Joe Biden to federalize the Texas National Guard and take it out of the state’s control, according to Newsweek. Paxton said he doubts a physical confrontation will ensure, saying he expects the issue will be fought out in court, according to Fox News. Meanwhile, the Border Patrol union posted a defiant message on X. “Rank-and file BP agents are not going to start arresting TX NG members for following their LAWFUL orders. That’s fake news. TX NG and rank-and-file BP agents work together and respect each other’s jobs. Period,” the union posted. “If TX NG members have LAWFUL orders, then they have to carry out those orders. TX NG members realize that rank-and-file BP agents have their orders as well. Lawful orders, no matter how unpopular or distasteful amongst rank-and-file agents, must be followed,” the post said. Newsweek reports that Republicans are throwing their support behind the Texas governor in the border-related dispute. In case you missed it, the Supreme Court rendered the ruling last Monday. The issue before the justices of the Supreme Court was the razor wire fencing that Texas has installed at the U.S.-Mexico border. This is one of several legal disputes regarding the U.S.-Mexico border that is currently taking place between Texas and the Biden admin. Texas, in general, has been arguing that it has to take matters into its own hands because the Biden administration refuses to secure the border. The razor wire fencing is one example of Texas taking matters into its own hands. Regarding the razor wire, the justices of the Supreme Court have sided with the Biden administration. ABC News reports: A narrowly divided Supreme Court on Monday sided with the Biden administration in a tense, ongoing dispute over the Texas-Mexico border and razor wire fencing installed by the state that had prohibited federal border agents from performing their duties. The court, by a vote of 5-4, cleared the way for federal agents to remove the wire, which administration officials and immigration advocates had called dangerous and inhumane. The outlet goes on to report that “the Supreme Court’s order did not elaborate on the decision.” Newsweek highlights an important fact about the Supreme Court’s ruling, writing, “Notably, the ruling does not bar Texas from constructing more razor wire and only says that the federal government must be able to take it down when deemed necessary.” Since the ruling, reports indicate that Texas has continued to erect razor-wire fencing. It has also been reported that the state has not engaged in efforts to prevent the federal government from removing some of the fencing. It is unclear whether the federal government has removed any of the fencing. Abbott announced that his state will not “back down from our efforts to secure the border.” This triggered Democrats to call on President Biden to federalize the National Guard. The razor wire along the border was set up by the Texas National Guard and the state’s Department of Public Safety. In a Jan. 26 interview with Tucker Carlson, Gov. Abbott was asked about his response if President Biden goes ahead with the proposal. “Well, first, I'd be shocked. That would be a boneheaded move on his part—total disaster,” Gov. Abbott said. “For one, as you might imagine, we are prepared in the event that that unlikely event does occur to make sure that we will be able to continue exactly what we’ve been doing over the past month, and that is building these barriers.” “Whatever we’ve been building, the Biden administration is now trying to attack us because of it, and we will continue to do exactly what we’re doing to expand our denial of illegal entry into the state of Texas.” Gov. Abbott pointed out that state forces were already operating at the border and that he expects more forces to come to Texas from other state National Guards. “There’ve been about ten [states] so far that have sent National Guard or other law enforcement … They now are joined together with us. This is a fight for the future of America, and they all know it. And so I believe that they will all be in on this effort.” In an interview with Bloomberg on Thursday, the governor said that Texas was “adding more razor wire as we speak right now to make sure that we are doing even more to secure the border.” Gov. Abbott insisted that his state has the authority to defy the U.S. federal government in accordance with the U.S. Constitution since the founding fathers believed that “there would be times when the federal government does not do its job and states have a right of self-defense.” On Wednesday, Gov. Abbott accused the Biden administration of failing to fulfill the duties outlined in Article IV, Section 4, which asks the federal government to protect each state against “invasion.” President Biden’s failure has triggered “Article 1, Section, 10, Clause 3, which reserves to this State the right of self-defense,” he said. The governor declared an invasion under Clause 3 and invoked “Texas’s constitutional authority to defend and protect itself. That authority is the supreme law of the land and supersedes any federal statutes to the contrary.” The conflict between the federal government and Texas comes as the U.S. border patrol registered 302,034 encounters with illegal migrants along the southwest land border in December—the highest level since 2021. Because really all states in America have become a border state, we’re all seeing this influx and being invaded as Gov. Abbott said. It is an invasion,” Hodges said. “I don’t really know how it’s going to play out. I just applaud Gov. Abbott’s courage and the other governors who stand with him. Hopefully, it will make a difference. Hopefully, this is a wake-up call for President Biden and for Congress to say people are sick of it,” she added. Driver Bruce Poppy insisted that it is time to “stand up” against the Biden government’s dangerous border failures. “We need to stand up,” Poppy said. “Our voices need to be heard. We need to bring people together. … That’s our right, our First Amendment right to peacefully assemble and redress our grievances for our government. We have not be able to do that.” Participant Y. G. Nyghtstorm also spoke to NewsNation about why many of the convoy participants have hit the road to make a statement about the state of the country and the failures at the border. “With our President Joe Biden, I say that he’s been an absentee father for our country,” Nyghtstorm exclaimed. “He can protest everybody else and send resources to everybody else, but what about your family here at home? Charity begins at home.” “You just can’t break into our home,” Nyghtstorm said of the millions of illegal border crossers. “We have to protect our house, and that’s what this is about. It’s not about violence. It’s about our love for our country and people coming together, standing for the right thing.” Nyghtstorm also blasted the “propaganda” of the leftists who say that the members of the convoy are armed and dangerous. “I tell ya, propaganda is so funny,” Nyghtstorm said, waving off the concerns as ridiculous. “We are not coming with violence … Anytime you try and do something good, there’s always somebody that’s going to have something negative to say.” “The law is the law. Right is right. And we got to protect our house,” he said. The organizers of the convoy said they also plan to stop in Eagle Pass, Texas, and San Ysidro, California.
